In 1986, California voters approved Proposition 65 (formally titled “The Safe Drinking Water and Toxic Enforcement Act of 1986). One of the most visible signs of this act are the warning signs you see posted in eating establishments, airports, grocery stores and on a number of other commercially sold products. While the act remains quite controversial, most companies have chosen to post Proposition 65 warnings in their establishments or include warnings on product labels in cases where products may contain any of the listed chemicals. Many of the substances on the list are naturally occurring in the environment and specifically in the soil in which plants are cultivated, and when naturally occurring are exempt in natural levels from Proposition 65, however, it is very difficult to prove that the substances are naturally occurring. Some of these substances may accumulate in varying amounts, at different times. Because of this, it is possible that some of the substances on the list may from time to time be present in our products—so we are including this warning in order to fall within a safe harbor provided under Prop 65. To be fully compliant with Proposition 65 we included the relevant warning available on our website. Proposition 65 is a law specific to the state of California and US Federal law has not banned the use of the listed chemicals, so while we believe the levels of chemicals in our products are safe, we are required to include a warning on the applicable product under Proposition 65 or discontinue selling the product in California.
